GET RID OF YOUR CLOUDED TITLE
A Quiet Title is a lawsuit that is used to clear up or “quiet” problems with your title to real property that usually arises when there is a question about clear title, or there exists a problem in the chain of title. For example, a Quiet Title is a judicial tool that can be used to clear up tax deeds, old mortgage’s that were never properly satisfied, errors in the legal description which casts doubt on the amount of property owned, among other issues.
An action for quiet title requires the description of the property to be “quieted,” naming the defendants as anyone and everyone who may have an interest in the real property. This sometimes includes descendants (known or unknown) of prior owners (dead or alive). Notice to anyone involved is the most important part of the Quiet Title suit. We must notify all potentially interested parties, including known and unknown, either by service of process or by publication.
Once all the steps in the legal process has been completed, a quiet title judgment will be granted by the Judge issuing you clear title.
